Regulations Amending the Onshore Pipeline Regulations, 1999, SOR/2013-49

The Regulations Amending the Onshore Pipeline Regulations, 1999 (Regulations) were published in the Canada Gazette, Part II on 10 April 2013. Note that as a result of the Regulations, the Onshore Pipeline Regulations, 1999 are now renamed as the National Energy Board Onshore Pipeline Regulations.

The Regulations and the associated Regulatory Impact Analysis Statement (RIAS) are available on the Canada Gazette website:

  • under 'Archives', click on 'Part II Official Regulations;
  • under 2013, click on Part II and go to April 10, 2013, Vol. 147, No. 8;
  • the Regulations and RIAS are on pages 808-820.

The Regulations clarify requirements for federally regulated pipelines regarding management systems for the purpose of protecting the public, workers and the environment.

The Regulations are now in effect and companies should take note of the new requirements contained therein including the new submission requirements at section 6.2. Please see the NEB website (www.neb-one.gc.ca, Acts and Regulations, Onshore Pipelines) for information on how to make the required submissions including suggested template letters.
