NEB seeks comments on proposed Damage Prevention Regulations
CALGARY - The National Energy Board is seeking comments from the public on proposed Damage Prevention Regulations that will eventually govern all activities which could damage a pipeline, including vehicle and mobile equipment crossings. The proposed new regulations will apply to pipeline companies as well as a significant number of Canadians who own land crossed by a pipeline or who undertake activities that could damage a pipeline.
The Board released today a document entitled A Conceptual Draft of the Proposed National Energy Board Damage Prevention Regulations & Guidance Notes. The document contains the framework, concepts and ideas that will eventually form the new regulations. New concepts being proposed include revisions to the current approval requirement for excavations using power-operated equipment or explosives within 30 metres of a pipeline. Also suggested is that pipeline companies under the Board's jurisdiction have mandatory membership in "One Call" centres.
To ensure Canadians are provided with an opportunity to participate in the development of these Regulations, the Board intends to meet with stakeholders over the next six months. Planning is underway for "town hall" style meetings at numerous locations across Canada. Details of these meetings will be announced as they become available.
The Board also released today the results of a national survey of Canadians who own land crossed by a federally-regulated pipeline (the Canadian Pipeline Damage Prevention Regulations: Landowner Survey). This survey was conducted for the Board by Compas between January 17 and February 2, 2002 and will be used in the development of the new regulations.
The NEB is an independent federal agency that regulates several parts of Canada's energy industry. Its purpose is to promote safety and security, environmental protection, and efficient energy infrastructure and markets in the Canadian public interest, within the mandate set by Parliament in the regulation of pipelines, energy development and trade.
