Introduction

  • The purpose of the workshop was to give an overview of the NEB LMCI Streams 1 to 4 to landowners and landowner representatives and to invite their comments and questions.

Comments on Stream 1

  • Compliance and enforcement to NEB expectations will be covered under Inspections and Audits. Examples of non-compliance or violation will be provided.

Comments on Stream 2

  • Concerns over compensation matters will be recorded and forwarded to NRCan who deals with the issue of compensation, the Board having no authority in this matter.
  • Landowners are concerned with the Right-of Entry and Expropriation processes they have to go through under the Act and are very concerned about the way they are dealt with.
  • Land acquisition process should be revised and changed to be more sensitive to landowners who feel powerless under the current process and see their properties decreasing in value due to the presence of pipelines on their lands.
  • CAPLA presented the NEB and other participants with two documents representing their positions or responses to the NEB LMCI Discussion Papers for Streams 1 and 2. The documents represent the basis of CAPLA's positions and were provided as a starting point for the conversations that will be taking place during the LMCI process.
  • The issue of interaction between the NEB and landowners is included in Stream2 under the subsection Transparency of Decision-Making. Participants are encouraged to bring up this issue at the workshop tomorrow during the conversations.

Comments on Stream 3

  • Some participants are concerned regarding the timing of the Stream 3 Hearing scheduled for June 2008 and the LMCI tight deadline. Participants were invited to express their concerns over the tight deadline and submit their recommendations in writing to the Board.
  • The LMCI is an unprecedented opportunity to move forward and landowners are encouraged to participate as their input is valuable to the Board.
  • The Board hopes to hear evidence throughout the process from the participants and interveners regarding the cost of pipeline removal. Stakeholders are asked to identify and communicate the needs landowners have in regards to hiring experienced legal counsel in order to participate adequately in the process and provide evidence.

Comments on Stream 4

  • Due to their lack of funding, landowner representatives are concerned about being able to present their position and views on how to best protect landowners and produce expert evidence in regards to Stream 4.

Other Comments

  • Landowner associations would like to see landowners amongst Board Members to ensure that landowners get the same recognition as industry stakeholders and are better understood and represented.
  • Participants expressed their desire that Board Members be more present at the LMCI workshops and meetings to show their commitment to the LMCI.

Closing Remarks

  • The Board values the participation of Landowners and Landowners Association and appreciates the documents that CAPLA produced in response to the LMCI Discussion Papers for Streams 1 and 2.
  • The Board looks forward to working with landowners and stakeholders in order for the LMCI to be productive and for the Board to make decisions that are in the best public interest.
