LMCI Stream 4 Meeting Summary - Canadian Alliance of Pipeline Landowners' Associations (CAPLA) - 14 April 2008

  • Discussed recent letter from CAPLA regarding participation in Stream 3 and 4 as well as next steps.
  • CAPLA indicated that they were looking for direction from the Board for next steps.
  • Staff provided some clarification of the expectations of the Board with respect to the outcomes of Stream 4. Staff has provided clarity to both CAPP and CEPA using the same key messages provided at regional workshops and these meetings have seemed beneficial to the parties. This information is below for circulation to CAPLA members and other interested parties.
  • CAPLA indicated that it may have misinterpreted the expectations of the Board in Stream 4 and that funding may not be necessary to prepare a response to the discussion paper. With that in mind, CAPLA indicated that the May 8th deadline may be achievable. Staff will follow up with David Core at the CAMPUT meeting to further clarify the Board's expectations and determine next steps for the process in Stream 4.
  • CAPLA discussed the recent court decision and the impact it had on landowners in Ontario. CAPLA indicated that it may be useful to the Board to have copies of the evidence assembled in preparation for the court proceedings. CAPLA committed to filing the information as part of CAPLA's LMCI submission for all Streams.
  • CAPLA expressed cautious optimism for the outcomes of the LMCI and offered support in bringing landowners to the table to provide suggestions for improvement that can be used by the Board.

Stream 4

There are three objectives for Stream 4:

Objective 1: Identify high-level principles that will provide guidance to industry, landowners, and other affected parties in planning for the retirement and reclamation of pipeline facilities at the end of their life.

  1. In this regard the Board has proposed 10 principles in its discussion paper released in February
  2. Board expectation for May 12th input: Parties will provide input on the appropriateness and adequacy of the proposed principles.
  3. Final outcome of the LMCI: the Board will decide on a suite of principles that will be influenced by what it hears during consultations. Any changes or additions to the proposed principles in the discussion paper will be circulated for comment before a final decision is released.

Objective 2: Identify gaps in knowledge and science with respect to the physical issues of abandonment.

  1. The Board has identified a number of known gaps in its discussion paper.
  2. Board expectation for May 12th input: Parties will identify any additional gaps that should be considered in a future research plan.
  3. Point of clarification: The Board is not looking to fill the knowledge gaps as part of the outcomes of Stream 4 - only to identify what the gaps are at this point in time so that an action plan can be developed and funded to move forward.
  4. Final outcome of the LMCI: The Board will release a list of gaps in knowledge and science that will be used as a preliminary list of issues to be researched in the future (see Objective 3). There will be an opportunity to comment on the list of issues before it is finalized.

Objective 3: Develop an action plan for moving forward to fill the knowledge and science gaps.

  1. Board expectation for May  12th input: Regulated companies and interested parties will commit to participation in a round-table committee or council and provide recommendations for the group's structure and terms of reference.
  2. Final outcome of the LMCI:
    1. A group is established whose participants are committed to ensuring that appropriate research is initiated and completed.
    2. Terms of reference and a source of funds will be established for the group.
    3. The preliminary list of issues identified in the second objective above will be used as the starting point for the research mandate of the group.
