Trans Mountain Pipeline ULC - Expanded Trans Mountain Pipeline System Part IV Tolling Application - RH-001-2012

Project Information

Trans Mountain Pipeline ULC (Trans Mountain), which is operated by Kinder Morgan Canada and owned by Kinder Morgan Energy Partners, L.P., filed an application on 29 June 2012, for approval of the toll methodology that would be implemented on the proposed Trans Mountain expanded system, if the system is eventually expanded.

In assessing a proposed toll methodology, the Board considers whether the resulting tolls would be just and reasonable, and not unjustly discriminatory to any shippers. To determine these things, the Board considers all relevant factors specific to each application.

A tolling methodology application under Part IV (Traffic, Tolls and Tariffs) of the NEB Act does not require that the Board hold a public hearing but the Board may convene one if it deems it appropriate.

In this tolling methodology application, Trans Mountain is not seeking Board approval for its facilities expansion at this time and Trans Mountain has not filed a facilities expansion application with the Board.

If Trans Mountain submits a facilities application, the assessment process for that application would be determined at that time. In assessing an application for a certificate filed under Part III of the NEB Act - Construction and Operation of Pipelines - the Board is to consider matters that appear to it to be directly related to the pipeline and to be relevant and will generally include factors such as:

  • the need for the proposed facilities;
  • the availability of supply and the existence of markets;
  • the economic feasibility of the proposed facilities;
  • the financial responsibility and financial structure of the applicant;
  • the potential environmental effects of the proposed facilities;
  • engineering issues to assess whether the pipeline can be designed, constructed and operated in a safe manner; and
  • any other public interest that may be affected by the issuance or the dismissal of the application.

A facilities application under section 52 of the NEB Act must involve a public hearing and may include participant funding.

The Board conducted a public hearing process from February 12-21, 2013 in the Board’s Hearing Room, 2nd Floor, 444 - Seventh Avenue SW, Calgary, Alberta.
