– RoW in thick trees/brush and crosses shallow drainage channel; RoW also parallels the drainage channel for approximately 200 m
– physical condition of artificial watercourse at the crossing location was adequate
– Enbridge stated that the channel was classified as a Fill Regulated Area under the Conservation Authority Act therefore brushing not permitted in close proximity to the channel

– the O&M site and surrounding lands was gravel and non-vegetated due to its location within the motel parking area

– observed presence of old railway ties and other debris on RoW near the dig site location
